These Terms of Service ("Terms") are an agreement between you (the "Customer") and WhoVisitedMySite, Charleston, SC ("we", "us"), for use of the WhoVisitedMySite website visitor-identification service (the "Service"). By starting a trial or subscription you agree to these Terms and our Privacy Policy.
1. Subscriptions
The Service is sold as a monthly or annual subscription on the Starter, Growth or Pro plan. Each plan includes a set number of websites and identified visitors per billing period, as shown on our pricing page. Subscriptions renew automatically at the end of each billing period until cancelled. Prices exclude applicable taxes.
2. 14-day free trial
New accounts get a 14-day free trial. A valid payment card is required to start the trial. If you do not cancel before the trial ends, your card is charged for the plan you chose and your subscription begins. During the trial, you see identified visitors as they arrive, subject to trial limits; some identified visitors may be counted but held until your paid plan starts.
3. Cancellation
You can cancel at any time from your dashboard using the Cancel link, with one confirmation step. Cancellation takes effect at the end of your current trial or billing period, and you keep access until then. No refunds; cancel anytime. Fees already paid are not refunded except where required by law.
4. Overage
If you identify more visitors than your plan includes in a billing period, extra identified visitors are billed at your plan's overage rate (shown on the pricing page), monthly in arrears. We email you when you reach 80% and 100% of your allowance. You can upgrade at any time. On annual plans, overage is billed monthly as a separate charge from your annual plan fee.
Customer is responsible for applicable sales and use taxes.
5. Your responsibilities and acceptable use
- Disclosure. You must post an accurate privacy notice on every website where you install the pixel, disclose the use of cookies, pixels and visitor identification, obtain any consent required by law, and honor visitor opt-out requests. During setup you confirm that you will post a tracking disclosure in your privacy policy and use a consent banner where required.
- TCPA and Do Not Call. You alone are responsible for complying with the Telephone Consumer Protection Act, the National Do Not Call Registry, state telemarketing and "mini-TCPA" laws, and similar rules. Do Not Call flags are provided as a convenience and may be incomplete or out of date; you must scrub and obtain any required consent before calling or texting. Pro plan phone data requires accepting our calling-compliance terms: before mobile numbers are shown, you attest that you will only call or text with consent and comply with the TCPA and Do Not Call rules, and we store the time you agreed.
- Email. You must follow CAN-SPAM and similar laws when emailing identified visitors.
- Prohibited uses. You may not use the Service or its data for decisions about credit, employment, insurance, housing or other eligibility purposes covered by the Fair Credit Reporting Act; to harass, stalk or discriminate; to target children; on websites with sensitive content (such as health, sexual orientation or religion) without our written approval; to resell or redistribute the data as a list; or in violation of any law.
- You may not interfere with the Service, reverse engineer it, or share your account with others.
We may suspend or terminate accounts that violate these Terms.
6. No guarantee of match rates
Identification depends on third-party data, browsers, devices and privacy tools. Many visitors cannot be identified, and match rates vary by site and audience. We do not guarantee any number or percentage of identified visitors, or the accuracy or completeness of any data. The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim.
8. Indemnity
You will defend and indemnify us against claims arising from your websites, your use of visitor data, or your breach of these Terms or applicable law, including TCPA, Do Not Call and privacy claims.
9. Changes
We may update these Terms or our prices. We will give at least 30 days' notice by email of material changes, which apply from your next billing period.
10. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Charleston County, South Carolina.
